Questions We Get · Visas and Working Abroad

We Have Employees on Work Visas or Working Outside the United States. Can You Help?

Those are two separate questions.

Visa-holding employees working in the US are generally eligible for your plan on the same terms as anyone else, subject to how your eligibility rules are written. People physically working outside the US are a different problem, because a domestic plan’s network does not follow them and the right answer usually involves separate arrangements. Tell us which situation you are in and we will tell you whether it is straightforward.

The Substance

What Is Actually True About Visas and Work Abroad

What Is Actually True

  • Employees working in the US on a visa are generally treated like other employees for eligibility, based on your plan’s rules.
  • Hours and status, not immigration category, drive the full-time determination for employer mandate purposes.
  • A domestic plan’s network is built for people in the US and does not follow someone working overseas.
  • Coverage for employees located abroad generally needs arrangements outside the domestic plan.

What CFH Does About It

  • We check that your eligibility language treats visa-holding employees consistently.
  • We tell you plainly whether your situation is a domestic one.
  • We work with you on the US-based workforce and are straightforward about what a domestic plan cannot do for people abroad.
  • We arrange group international medical coverage for employees abroad when the domestic plan will not reach.

The Detail

Employees on Visas or Working Abroad: The Detail

Workers on visas or outside the country raise eligibility and coverage-area questions. These are the main ones.

Visa Status Does Not Set Eligibility

Eligibility is generally determined by the plan’s terms, not immigration status. Carriers and plan documents set waiting periods, hours requirements and other conditions, so treat every employee the same way under those terms. For questions about work authorization or immigration, ask employment counsel before you act.

Service Areas Matter

A domestic plan’s network may not cover care outside the country. Employees who travel or live abroad for part of the year should check how emergency and routine care are handled away from home. A short written summary of what the plan does and does not cover prevents surprises.

International Medical May Be Needed

For employees working abroad, a separate international group medical arrangement can fill the gap. Whether that makes sense depends on where people work, how long they stay and what the employer wants to offer. Your adviser can help compare options, and counsel can review any local requirements that may apply.

ACA Counting Can Be Complex

Federal rules decide which employees count, and foreign work may change that. Employers should not assume that employees on temporary visas or working overseas are treated the same way as other employees. Confirm the treatment with your tax adviser or counsel before you rely on it.
