Form 5500 extension: how Form 5558 works and when it is too late.

Form 5558 gives a plan two and a half more months to file, but only if it is filed on time. This page covers the dates for a calendar year plan and what to do if both dates pass. It is general information, not legal or tax advice.

Talk Through Your Filings

What To Know

Three things to know first.

Two And A Half More Months

Form 5558 moves a calendar year plan from July 31 to October 15. For plan year 2025, that date is October 15, 2026.

File By The Original Due Date

The extension request has to be filed by the original due date, which is the last day of the seventh month after the plan year ends.

It Is Not Retroactive

An extension cannot be requested after the due date has passed. A return that is already late goes through the voluntary program instead.

What To Do

Three steps to take next.

Check Your Plan Year End

Confirm the plan year end date, then count seven months. Plans that do not run on a calendar year have different dates.

File The Form Before The Due Date

If the data will not be ready, file Form 5558 before the original due date and set a hard internal date for the return.

Have A Backup Plan

If October 15 passes without a return, the penalty clock counts from the original due date. Move to the voluntary program right away.

What To Ask

Three questions to ask first.

Who Files The Extension?

Ask your provider whether Form 5558 is included and who tracks the original due date.

What Is Our Real Due Date?

Ask for the due date for each plan, with and without an extension, in writing.

What If We Miss It?

Ask what the provider does if the extended date passes, and how fast late returns can be filed.

The Detail

The Form 5558 Extension: The Detail

Form 5558 is simple but unforgiving about timing. These are the details that decide whether the extension works.

It Adds Two and a Half Months

For a calendar-year plan, the Form 5500 deadline moves from July 31 to October 15. Employers should calendar both dates and treat the longer deadline as a buffer, not a target. Confirm the plan year and any exceptions with the adviser or the filing preparer, since the dates depend on the plan year the form covers.

It Must Be Filed by the Original Due Date

Form 5558 is not retroactive. If the original due date has passed, the extension is not available. Employers who suspect they may miss the filing date should ask the preparer about the extension well ahead of time. Keep a copy of the request and any confirmation, and ask counsel what options remain if the date has already passed.

Tax Extension Can Serve as an Alternative

When the plan year and the employer’s tax year coincide and the employer has an automatic extension of its income tax return, the Form 5500 extension can follow it without a separate Form 5558. Find your own dates with our Form 5500 due date calculator.

It Extends the Filing, Not the Plan Work

The extension does not change when contributions, notices, or plan compliance tasks are due. The extension changes only the date of the return. Employers should keep contribution deposits, participant notices and other plan obligations on their own schedules, and ask the plan adviser or counsel to confirm each date so none is delayed by mistake.

Common Questions

Common Questions About Form 5558

What is Form 5558?

An application to the IRS for an extension of time to file certain employee plan returns, including Form 5500.

How long is the extension?

Two and a half months past the original due date.

Do we have to give a reason?

No. The extension is automatic when filed on time.

Where is Form 5558 filed?

It is filed with the IRS at the address in the form’s instructions, and it is not filed through EFAST2.

Can we file Form 5558 after the deadline?

No. It must be filed on or before the original due date of the return.

Does the extension apply to the DOL too?

A timely Form 5558 extends the Form 5500 due date for both agencies since the return is a single filing.

Do we need to extend every year?

Only if you need extra time. Each year’s extension is a separate filing.

What if our plan year is not the calendar year?

The original due date is the last day of the seventh month after the plan year ends, and the extension adds two and a half months to that date.

Should we plan to extend as a habit?

It is a safety valve, not a strategy. If year-end data from carriers or a TPA tends to arrive late, we suggest building the extension into the calendar early.
