An applicable large employer files a 1094-C transmittal and a 1095-C for each full-time employee with the IRS each year, covering the prior calendar year. Paper filings are due by the end of February and electronic filings by the end of March. An employer that files 10 or more information returns of any kind, counting W-2s and 1099s, has to file electronically.
An employer may post a notice that employees can request a 1095-C instead of mailing one to everyone. The notice goes up by March 2 and stays up through October 15. A requested form goes out within 30 days of the request. Many employers still mail forms because it avoids the request process and the questions that come with it.
It applies to applicable large employers, which means 50 or more full-time employees including equivalents. Our 50-employee calculator shows where you stand.
The date moves to the next business day. The calculator makes that adjustment for the IRS dates.
The IRS allows an automatic 30-day extension for filing with a Form 8809, and a separate extension for furnishing forms in limited cases. Confirm the current rules with your vendor.
The IRS can assess a penalty for each late or incorrect return. Our penalty pages show examples and how reasonable cause can reduce them.
