A planning estimate, not legal advice. A plan can allow a longer window than the minimum shown here. Check your plan document.
Federal law lets an eligible employee or dependent join a group health plan outside open enrollment after certain events. The events are the loss of other coverage, marriage, the birth, adoption or placement of a child, and a change in Medicaid or CHIP status. The window is 30 days for most events and 60 days for the Medicaid and CHIP events.
The plan has to give the person the chance to enroll and has to start coverage on time. Coverage for a birth, adoption or placement starts on the date of the event. For loss of coverage and marriage it starts no later than the first of the month after the plan receives the request. The Medicaid and CHIP events have a 60-day window set by federal statute, and the plan sets its own start date within that. Many employers allow a longer window than the minimum, which is a plan design choice.
It counts from the event, not from the day the employee learns of it. For a loss of coverage, count from the day the other coverage ended.
Yes. A special enrollment event for the employee can let the employee add eligible dependents. Some events, such as a birth, can also let an employee who is not yet enrolled join.
No. A mid-year election change under a Section 125 plan follows a separate set of rules. The two often line up, but the plan has to satisfy both. See our guide on qualifying life events.
Under the minimum rules the person waits for the next open enrollment. Some plans allow more time, so check the plan document before telling the employee no.
