If any of your employees or their covered spouses are Medicare-eligible, you owe them a disclosure each year saying whether your prescription drug coverage is at least as good as Medicare Part D. It goes out before the middle of October, and a second disclosure goes to the federal government within sixty days of your plan year starting.
There is no small-employer exemption on this one.
